A 5-year-old Florida boy, who police say severely beat his teacher but will not be charged over the incident, lacked the criminal intent that would be needed for prosecution, legal experts said.

The attack left a special education instructor at Pines Lakes Elementary School "sitting on the ground against the wall" when first responders reached her, as she appeared "to be in a faint state," according to Pembroke Pines police.

Police: Teen dies after boys shoot at each other while wearing body armor
BELLEVIEW, Fla. (Gray News) - A Florida teenager is dead and two others have been arrested after police said the boys took turns shooting at each other while wearing body armor.

The Belleview Police Department responded to a call of a shooting over the weekend at a house and found 16-year-old Christopher Leroy Broad Jr. shot inside of the home. He was transported to a hospital but died from his injuries.

Police said through their investigation they found 17-year-old Joshua Vining and Broad were taking turns shooting at each other while wearing a vest that contained a form of body armor. BPD Sgt. Michael Miley said Broad Jr. died after he was hit by a bullet fired by Vining, according to the evidence found.

I'm not sure a crime was committed. There was no intent and he did it with the permission of the "victim" - implied because they were taking turns. It will be interesting to hear if he is cut loose by the DA.

In my state it is illegal to discharge a firearm within 500 feet of a dwelling, so it would certainly be a crime here.

Looking in details in Florida, there are laws for discharging weapons in public property within 500 feet of a residence (private building) or (amended in 2012j firing outdoors across neighboring property if fired from private property. No laws governing indoor discharge of a firearm on private property.

i see possible negligent homocide but it really depends on the claim the vest manufacturer made to determine how negligent they were. Could be a case of product failure.
