The reason is obvious, it's policing for money.It has always bewildered me how these civil asset forfeiture laws ever got passed, let alone haven't been thrown out by every court that has ever had the opportunity to rule on them. I also can't understand why this hasn't resulted in a huge class-action lawsuit.
Oh, I understand why the executive branch loves it -- I'm just very dismayed that the judicial branch won't do their job and throw it out. It strikes me as a direct violation of due process, and I simply don't buy the bullcrap argument that they are somehow only taking action against the seized asset and not against the person when the fifth amendment specifically includes property.The reason is obvious, it's policing for money.
And the 2nd says "...shall not be infringed", but most states ignore this as well....when the fifth amendment specifically includes property.
