I bought two MAX038 from China and got same problem with the same schematic circuit but with 7905 x 7805 power supply as technical need.
Both chips got the same amperes as your and get hot as your.

Do you got your problem solve in your old times?

Yes, I place the caps as in the datasheet.
Include,in the power supply, I place too because wire inductance.

I did the both prototyping circuits, the one in the main datasheet chip, page 11

Both as they are there inlude all as in the datasheet 7805/7809 about capacitors and filters.

 

This is the actual oscilloscope print screan.

The negative conector get 1.31 A and in the way to the chip get hot, the Ampere decrease.
The 7905 get so hot to need to place a massive heat sink.

 

When the chip arrived at home, I opened for both a similar dispute because both, one from ebay and other from Aliexpress site, where I found the dispute in both same cases, about both has arrived with the pins marks of has been inserted before.
