Teen wrestler charged with punching opponent at Oak Park event

CHICAGO (CBS) – The 14-year-old wrestler who punched his opponent after he lost a match at an event in Oak Park earlier this month was charged with assault under a local ordinance.

Police said they were called to the Oak Park-River Forest High School fieldhouse in response to the incident on April 8 just after 4 p.m. Police spoke with the suspect and his parents. The suspect said he struck his opponent because he was angry that he had lost the match. The suspect and his family said they would cooperate with any future investigation, police said.

I hope he walks, too, but there are a couple of sticky points. First, it can be argued that use of lethal force wasn't justified since, at the time he engaged the guy, he was running away and posed no imminent threat to anyone. Second, leaving the scene after you've just shot someone -- not the best thing to do. That, by itself, might be a chargeable offense. Third, leaving legalities aside, he should have gone to the person he shot to either secure them and/or render aid. If he had survivable wounds but died because no aid was rendered, that might be a legal issue. Another issue, which may or may not have legal implications, is that he discharged his weapon under circumstances when doing so clearly presents a risk to others -- the path of that bullet looks like it goes back into a busy street and whatever's across from it. Ignoring that in a situation in which life and limb are under imminent threat is one thing, doing so when they aren't is a lot harder to justify.

Having said all of that, I hope that the grand jury adequately takes into account that the shooter had perhaps five seconds from the time they reasonably could have noticed that a violent crime was being committed until they took action in what was clearly going to be a high-stress situation.

The only time injustice is served under these circumstances the recipient from a gun to the side of the head is as deadly as a brick, you can still die. All that was done is good people did something, it’s when good people don’t notice or turn blind eye’s to crime.
